Srinagar : Senior Hurriyat leader and chairman Jammu Kashmir Democratic Freedom Party (DFP) Shabir Ahmed Shah has said that Jammu and Kashmir has never been a part of India and thus no act of Indian parliament, no piece of legislation or any judicial order has any moral and legal standing.In his message from Tihar jail the incarcerated leader, while referring to the promises the secular touting Indian leaders had made with the people of Kashmir from time to time, said that the Indian supreme court verdict was yet another big betrayal involving the breach of trust and violation of commitments.He said that the Indian court has miserably failed to do justice with the people of Kashmir. “The Indian judiciary has a history of being biased towards Kashmiris”, he said, adding that execution of Shaheed Maqbool Bhat and then judicial murder of Shaheed Afzal Guru in a sham trial serve as worst examples of prejudice and injustice.He said that the Indian supreme court has repeated the history and instead of hearing the case on merit and do justice, the five-judge bench has preferred to satisfy the Modi government.”The court verdict has been a big disappointment for the pro-India political parties but for a vast majority of the Kashmiris it was a non issue as they believe that Kashmir is a disputed territory that was illegally and forcibly occupied by India in 1947″, he said, adding that expecting any good from a country that has breached the international obligations and violated its commitments was a futile exercise. “Reinstating article 370 is not the real issue or demand of the Kashmiri people”, he said, adding that holding referendum in the region in line with the UNSC resolutions, allowing the people of the region to exercise their right-the right to self determination and providing them an opportunity to determine their political was the only thing Kashmiri have been demanding and fighting for the past several decades.He said that instead of fulfilling the Kashmiris’ just demand, the Indian government was trying to further complicate the issue by weaving a cob of confusion around it.He said that such tactics won’t really help India from running away from the reality i.e. Kashmir is a UN recognized disputed territory still pending on the UN agenda.As per the UN resolutions, the Indian government has no mandate or authority to to change the disputed nature of the Jammu and Kashmir or annex the territory unilaterally either through an act of Parliament or a judicial order.”The Kashmiri people have rejected the move and made it clear that they won’t accept any thing short of freedom”, he said, adding that no decision can be imposed on Kashmiris.About the Indian government’s nefarious designs behind the abrogation of article 370 and 35-A, Shah said that what the Indian government was doing under this garb was really a matter of grave concern.India, he said, was hell bent on erasing the Kashmiris’ political, cultural and religious identity.He urged the Kashmiri people to stay vigilant and foil the nefarious designs of the Modi government that wants to create Palestine-like situation in the region thereby turning region’s Muslim majority into minority, and controlling Kashmir and all its resources.
